CM, these are new charges eminating from the Der Spiegel articles this article from the Guardian might help you. There is also a thread in respect to all this that dates back to May.

“The case against Manchester City for alleged breaches of Uefa’s financial fair play regulations will proceed to a full hearing after the court of arbitration for sport rejected City’s appeal against the charge being made.

City had appealed to Cas in May against the decision of Uefa’s club financial control body investigatory chamber to refer the alleged breaches to the CFCB’s adjudicatory chamber for a decision. The investigatory chamber is understood to have recommended that if the serious charges are proven, that City misled Uefa in 2013-14 about the source of sponsorship money paid to the club, City should be banned from the Champions League for a season.

The adjudicatory chamber, a five-person panel chaired by José Narciso da Cunha Rodrigues, a former judge at the European court of justice, and which includes the English barrister Charles Flint QC, is to start hearing the case in December, the Guardian understands.

The CFCB is set up to be judicially independent of the Uefa administration and its panels, composed of such senior European lawyers, are authorised to make decisions on guilt or innocence, and the appropriate sanction, based on the merits of the evidence.

City’s appeal against their referral to the adjudicatory chamber followed their furious public reaction, in which they accused the investigatory chamber of not giving the club a fair hearing, complaining that the referral decision was leaked shortly before it was publicly announced, and describing the process as “wholly unsatisfactory, curtailed and hostile”.

Cas ruled that City were not entitled to appeal at this stage because an arbitration case can be taken to Cas only against an actual disciplinary or final decision of a sports governing body. As, by definition, the case has yet to be heard by the adjudicatory chamber, City have not suffered any findings or sanctions to appeal against. They can argue at their adjudicatory chamber hearing that the process has been unfair.

The Cas panel ruled City’s appeal was “inadmissible” because: “An appeal against the decision of a federation, association or sports-related body may be filed with Cas … if the appellant has exhausted the legal remedies available to it prior to the appeal, in accordance with the statutes or regulations of that body.”

Cas was expected to reject City’s appeal on these grounds, as it follows a similar rejection last year of an appeal by Milan against a referral by the investigatory chamber.

The CFCB case against City follows “leaks” of the club’s internal emails and documents published by the German magazine Spiegel last year. They appear to show the club’s owner, Sheikh Mansour of Abu Dhabi, provided the money for the 2013-14 sponsorship of the club by the state airline Etihad. The investigatory chamber was evidently not convinced by the explanations City offered, and referred the case for a decision.

City continue to maintain strongly they are not guilty of any wrongdoing and accused the investigatory chamber of ignoring “a comprehensive body of irrefutable evidence”.

My understanding is that they have indicated that they would not accept an “appeal” as at this point there is nothing to appeal against.
The CAS considers appeals against decisions.
If such is made thet will be able to go back to the CAS with an appeal.

My guess is a fine will be the end product but Who knows when UEFA are involved.

The only thing UEFA are interested in is screwing as much money as they can out of City and banning an English team. If they had legal evidence , where has it been all this time? They need to start looking at there own organisation….again!!!

City have been juicing, is anyone surprised that an already proven corrupt institution gives them a slap on the wrist? Getting 400m or whatever it was before City even had a brand worth speaking of…

Other sides can complain about what Liverpool spend but it’s only ever surface level nonsense because we’re a well run financial institution. There are no dodgy deals and for all the big money signings we’ve made, the club can afford to hold this on it’s own legs.

It’s hilarious that even with all the steroids that we’re miles ahead of City. Having the best manager in the game is the key. Long long way to go before we can talk about having anything in solid but even just looking at it RIGHT NOW, it just should be possible, with their juicing.

Amazing how some idiots on here already shouting guilty, just wait your clubs turn will come, they always come up with anything to screw money out of clubs. A report from a paper and from a devious country that brought so much miseryv to the world will count little at the actual trail.

FFP is in theory a good idea, however it’s rubbish in practice.

You can remortgage the club to get capital as long as it’s thought you can afford the repayments.

You can sell the cubs stadium to get capital and rent it back.

Both of the above could put the future of the club in jeopardy in the future

What you can’t do it seems is get given money in the form of sponsorship that the governing body deem to be over the market value.

This of course is decided by members of a corrupt organisation that who get paid more than their market value….Pagan

Adlab and Brian, I think the problem with this appeal to CAS was it was unprecedented City were appealing against the right of UEFA to carry out a full investigation.

As Moos rightly says City are yet to be even charged by UEFA let alone be found guilty and sanctioned and nothing can happen in terms of appeals until that takes place.

Following the CAS ruling it does look likely that UEFA will now move ahead and charge City but there are no guaranteed outcomes in such things and there are question marks as to how a lot of what UEFA may decide is incriminating evidence was obtained.

But assuming City are charged and subsequently found guilty and sanctioned and nothing is guaranteed in legal matters then City can begin the Appeal process firstly City would probably have to appeal to UEFA themselves before taking the Appeal to CAS. Although I suspect they would probably accept a multi million pound fine but not a European ban which would be the harshest punishment UEFA could hand out.

Be a bit of an embarrassment for UEFA too if they had to ban their current European Champions from the competition.?

Lots of water to flow under the Bridge on this one before we know the actual outcome.

Uefa will try anything to get their greedy paws on more money, they need to be carefull cause eventually you fall over your own sword as so many of them in eufa and fifa have recently discovered.
